An educational institution of the Republic of Azerbaijan will be established in Istanbul, operating at primary, secondary school, and high school levels.
AzEdu.az reports that this is reflected in the draft law "On the Approval of the Additional Protocol to the Agreement on Cooperation in the Field of Education between the Government of the Republic of Azerbaijan and the Government of the Republic of Turkey dated October 31, 2017," which was discussed at today's session of the Milli Majlis.
It was noted that the current Additional Protocol was prepared for the purpose of implementing the Agreement on Cooperation in the Field of Education between the Government of the Republic of Azerbaijan and the Government of the Republic of Turkey dated October 31, 2017. The aforementioned Agreement defines the legal basis for cooperation in the field of education between the two states, provides for the development of relations between educational institutions, exchange of experience, and implementation of joint educational initiatives.
The Additional Protocol was concluded in accordance with Article 19 of the Agreement and regulates issues related to the commissioning of school buildings, the conduct of educational activities in these buildings, as well as management, finance, and repair-restoration. According to the Protocol, it is envisaged that an educational institution of the Republic of Azerbaijan will be established in Istanbul, Republic of Turkey, operating at primary, secondary school, and high school levels in accordance with Turkish legislation, as well as the mutual, indefinite, and gratuitous provision of appropriate buildings for the activities of "Baku Turkish Educational Institutions" in the Republic of Azerbaijan. In this case, the ownership rights of the school buildings are retained by the party providing them for use.
The document reflects provisions related to the implementation of education in the Azerbaijani educational institution based on the state educational programs of the Republic of Azerbaijan and international educational programs, the teaching of Turkish language and Turkish subjects, the provision of teaching staff, salary payment mechanisms, customs procedures for textbooks and teaching materials, as well as the issuance of temporary residence permits for teachers and their family members.
The Additional Protocol defines the use of school buildings solely for educational purposes, the procedure for terminating the right of use in cases of permanent cessation of educational activities, as well as the procedures for handing over and taking over buildings in a usable condition. At the same time, it is stipulated that repair, restoration, reconstruction, and additional construction works are the responsibility of the party to whom the building is provided for use, and in case of termination of the right of use, objects and structures subsequently built by that party shall remain the property of the party providing the building for use without compensation.
The Additional Protocol provides for the regulation of financial matters, including the collection of taxes and duties, in accordance with the national legislation of the parties.
